Terms of Service

1. Agreement to Terms
These Terms of Service ("Terms") constitute a binding legal agreement between you ("User," "you," or "your") and Technical Angler, LLC ("Technical Angler," "Company," "we," "us," or "our"), a South Carolina limited liability company. These Terms govern your access to and use of our proprietary and co-distributed mobile applications, websites, and related services (collectively, the "Services").
By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use our Services.
2. Definitions
For purposes of these Terms:
- "Technical Angler" means Technical Angler, LLC, a South Carolina limited liability company
- "Services" means our mobile applications, websites, and related digital services
- "User Content" means any content, data, or information you provide through our Services
- "Terms" means this Terms of Service agreement
3. Description of Services
Technical Angler, LLC develops and operates mobile applications, websites, and digital services that may include:
- User account creation and management
- Data logging and tracking capabilities
- Photo and media sharing features
- Educational content and resources
- Community features and user interactions
- Optional promotional activities and contests
- Integration with third-party service providers (including cloud hosting, crash monitoring, subscription management, and payment processing)
- Technical support and customer service
Our Services may include both proprietary applications developed by Technical Angler and co-distributed applications developed in partnership with other organizations.
4. Eligibility and Account Requirements
4.1 Age Requirements
You must be at least 13 years old to use our Services. If you are under 18, you represent that you have your parent's or legal guardian's permission to use our Services and agree to these Terms.
4.2 Account Creation
To use certain features of our Services, you must create an account by providing:
- A valid email address
- A secure password
- A username/display name
- Any additional required information specific to the Service
4.3 Account Responsibility
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Immediately notifying us of any unauthorized use of your account
- Providing accurate and current information
- Complying with these Terms and applicable laws
5. Acceptable Use
5.1 Permitted Uses
You may use our Services to:
- Create and maintain user profiles
- Input, track, and manage personal data
- Share content with other users (where applicable)
- Access educational materials and resources
- Participate in community features
- Enter contests and promotional activities (when available)
- Use integrated features and tools
5.2 Prohibited Uses
You agree NOT to use our Services to:
- Violate any applicable laws, regulations, or third-party rights
- Post false, misleading, or inaccurate information
- Share personal information about others without permission
- Harass, threaten, stalk, or harm other users
- Impersonate others or misrepresent your identity
- Upload viruses, malware, or other harmful code
- Attempt to gain unauthorized access to our Services or other users' accounts
- Use automated tools, bots, or scrapers to access our Services
- Spam or send unsolicited communications to other users
- Violate intellectual property rights
- Engage in commercial activities without our written permission
- Interfere with or disrupt the operation of our Services
- Create multiple accounts to circumvent restrictions
- Use our Services for any illegal or unauthorized purpose
5.3 Fishing, Boating, and Data-Accuracy Restrictions
The general acceptable-use rules in Sections 5.1 and 5.2 apply to all of our applications. In addition:
- Boating safety (all apps). You are responsible for your own safety on the water, including monitoring weather independently, carrying required safety equipment, following USCG and state regulations, and using appropriate charts and electronics for navigation.
- Catch data accuracy (all apps). Catch logs and program entries you record in our applications are your own records. Our applications do not validate them against state or federal regulations. You are responsible for complying with applicable size limits, bag limits, seasons, and licensing requirements in the waters where you fish, and for the truthfulness of any entries you submit to a partner program.
- Not for navigation (Inshore). Inshore displays tide, weather, and location data sourced from NOAA and other public providers. This data is for informational and recreational use only. It is not navigational data, not a substitute for official charts (NOAA ENC, paper charts) or marine weather forecasts (NWS marine warnings, USCG broadcasts), and must not be relied on for vessel navigation, safety-of-life decisions, or emergency response.
6. User Content
6.1 Content Ownership and License
You retain ownership of all content you submit to our Services ("User Content"), including:
- Photos, videos, and other media
- Text, comments, and posts
- Data entries and records
- Profile information
By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, transferable license to:
- Use, display, reproduce, and distribute your content within our Services
- Modify and adapt your content for technical and operational purposes
- Use anonymized and aggregated data for research, analytics, and service improvement
- Share content in accordance with your privacy settings and applicable laws
In plain terms: this license exists so the Services can function at all - storing your content on our servers, syncing it across your devices, processing photos you upload (for example, compression and previews), and displaying your content back to you. It does not transfer ownership of your content to us, and we do not sell it. Where an app includes features that share your content beyond your own account (for example, submitting an entry to a partner program), that sharing happens only through the features you choose to use. For Inshore specifically, Section 6.4 describes how narrowly this license is used.
6.2 Content Standards and Responsibility
You represent and warrant that your User Content:
- Is accurate and truthful to the best of your knowledge
- Does not violate any laws, regulations, or third-party rights
- Does not infringe on intellectual property rights
- Does not contain harmful, malicious, or inappropriate material
- Complies with our community guidelines and standards
6.3 Content Moderation
We reserve the right to:
- Review, monitor, and moderate User Content
- Remove content that violates these Terms or our policies
- Suspend or terminate accounts that repeatedly violate our standards
- Cooperate with law enforcement regarding illegal content or activities
6.4 Catch and Location Data (Inshore)
Inshore is local-first by design. Catches, logs, spots, and photos you record are stored on your device and synced to our backend so they survive device loss and replicate across your devices. We do not publish your data, share your spots with other users, or sell your catch records. The license you grant us in Section 6.1 is the minimum needed to operate the sync, display your data back to you, and process the optional NOAA enrichment described in Section 9.4.
7. Privacy and Data Use
7.1 Privacy Policy
Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information. The Privacy Policy is incorporated into these Terms by reference.
7.2 Data Usage Rights
By using our Services, you understand and agree that:
- We may use anonymized, aggregated data for research and service improvement
- Data may be shared with partners and clients in non-personally identifiable forms
- Technical data may be used to enhance functionality and user experience
- Certain features may require data sharing with third-party service providers
7.3 Data Security
We implement reasonable security measures to protect your information, but cannot guarantee absolute security. You are responsible for maintaining the security of your account credentials.
8. Intellectual Property
8.1 Technical Angler Property
Our Services and their content (excluding User Content) are owned by Technical Angler, LLC and protected by copyright, trademark, and other intellectual property laws. This includes:
- Application design, code, and functionality
- Technical Angler logos, trademarks, and branding
- Educational content and materials
- Documentation and support resources
8.2 Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to use our Services for personal, non-commercial purposes in accordance with these Terms.
8.3 Restrictions
You may not:
- Copy, modify, or create derivative works of our Services
- Reverse engineer, decompile, or attempt to extract source code
- Remove or alter any proprietary notices or labels
- Use our trademarks, logos, or branding without permission
- Distribute or resell our Services or any part thereof
9. Third-Party Services and Content
9.1 Third-Party Integrations
Our Services may integrate with or link to third-party services, websites, or applications. These include categories of service providers such as cloud hosting, crash and error monitoring, app-framework telemetry, subscription management, payment processing, and email delivery. We do not control these third parties and are not responsible for their content, privacy practices, or terms of service. Our Privacy Policy lists the categories of service providers we engage and the data each category receives.
9.2 Co-Distributed Applications
Some of our Services may be developed or operated in partnership with other organizations. These co-distributed applications may have additional terms and policies that apply to their use. Where a co-distributed application is operated on behalf of a partner organization that runs an entry-based program (for example, the Release Over 20 program), the partner's program rules govern the program itself, including eligibility, entry requirements, and any awards, and by submitting an entry you authorize us to share it with that partner. These Terms continue to govern your use of the application itself.
9.3 Third-Party Content
Our Services may include content from third parties. We do not endorse or take responsibility for third-party content, and your use of such content is at your own risk.
9.4 NOAA and Public Data Sources
Tide, water, and weather data displayed in our Services is sourced from third-party public agencies including NOAA. This data is provided "as is." We do not warrant its accuracy or timeliness and are not responsible for outages or errors in upstream feeds.
10. Disclaimers and Limitations
10.1 Service Availability
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE DO NOT GUARANTEE:
- Uninterrupted or error-free operation
- Complete accuracy of all information
- Compatibility with all devices or operating systems
- Permanent availability of any particular feature or service
10.2 Content Disclaimer
- Our Services may provide general information for educational purposes
- We do not guarantee the accuracy, completeness, or reliability of any content
- Users are responsible for verifying information independently
- We are not responsible for decisions made based on information in our Services
10.3 NO WARRANTIES
WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:
- MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT OF THIRD-PARTY RIGHTS
- ACCURACY, RELIABILITY, OR COMPLETENESS OF CONTENT OR SERVICES
10.4 Marine, Weather, and Boating Disclaimer
OUR APPLICATIONS ARE RECREATIONAL FISHING TOOLS. THEY ARE NOT NAVIGATION TOOLS, NOT WEATHER SERVICES, AND NOT SAFETY DEVICES. TECHNICAL ANGLER MAKES NO REPRESENTATIONS REGARDING THE SUITABILITY OF ANY OF OUR APPLICATIONS FOR ANY PARTICULAR FISHING TRIP, WEATHER CONDITION, BODY OF WATER, OR VESSEL. ANY DECISIONS YOU MAKE ABOUT WHEN TO FISH, WHERE TO FISH, WHETHER TO GO OUT IN PARTICULAR CONDITIONS, OR HOW TO NAVIGATE ARE YOUR OWN RESPONSIBILITY, MADE INDEPENDENTLY OF ANY INFORMATION DISPLAYED IN OUR APPLICATIONS.
11. LIMITATION OF LIABILITY
11.1 Exclusions
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TECHNICAL ANGLER, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND PARTNERS SHALL NOT BE LIABLE FOR:
- ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
- PERSONAL INJURY OR PROPERTY DAMAGE ARISING FROM YOUR USE OF OUR SERVICES
- DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA
- THIRD-PARTY CONTENT, ACTIONS, OR SERVICES
11.2 Aggregate Cap
To the maximum extent permitted by law, Technical Angler's total aggregate liability arising out of or related to these Terms or the Services, regardless of the form of action, will not exceed the greater of (a) the amount you paid to Technical Angler for the Services in the twelve (12) months preceding the event giving rise to the claim, or (b) fifty U.S. dollars ($50).
11.3 Time Limit on Claims
Any claim or cause of action arising out of or related to your use of the Services or these Terms must be filed within one (1) year after the claim or cause of action arose, or it is permanently barred.
12. Subscriptions and Purchases
Subscription Services. Some features of our Services (for example, certain "Pro" features within Inshore) require a paid subscription. Subscriptions are offered as monthly or annual plans at prices disclosed in the app at the point of purchase.
Free Trial. Where offered, the free trial period begins when you start your trial and ends after the disclosed number of days. You will not be charged during the trial. If you do not cancel before the trial ends, your subscription will begin and your default payment method with Apple App Store or Google Play will be charged at the price disclosed at signup.
Auto-Renewal. Subscriptions automatically renew at the end of each billing period at the then-current price for the same plan length, unless cancelled at least 24 hours before the end of the current period. Renewals are billed by Apple App Store or Google Play.
Cancellation. You may cancel a subscription at any time through your Apple ID subscription settings (iOS) or Google Play subscription settings (Android). Cancellation takes effect at the end of the current billing period; you retain access to subscription features until then.
Refunds. Refund requests are handled by Apple App Store or Google Play under their respective policies. Technical Angler does not directly issue refunds for in-app purchases. We may assist by directing you to the platform's refund process or contacting the platform on your behalf in exceptional cases.
Price Changes. We may change subscription prices for future billing periods. We will notify you in advance through the app, by email, or via the App Store or Google Play's standard change-notice mechanism, and you will have the opportunity to cancel before the new price applies.
Promotional Pricing. Promotional or early-access pricing, if offered, will be disclosed in the app at the time of purchase and may renew at then-current standard pricing as disclosed at signup.
Restore Purchases. If you reinstall the app or sign in on a new device, tap "Restore Purchases" on the paywall or in Settings to re-link your existing subscription. Restoration uses the Apple or Google account that originally purchased the subscription.
13. Indemnification
You agree to indemnify, defend, and hold harmless Technical Angler, LLC, its officers, directors, employees, partners, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:
- Your use of our Services
- Your violation of these Terms
- Your User Content
- Your violation of any laws, regulations, or third-party rights
- Your negligent or wrongful conduct
14. Termination
14.1 Termination by You
You may terminate your account at any time by:
- Using account deletion features in our Services
- Contacting our support team
14.2 Termination by Us
We may terminate or suspend your account immediately, without prior notice, if you:
- Violate these Terms or our policies
- Engage in harmful, illegal, or inappropriate activities
- Create risk for Technical Angler, other users, or third parties
- Fail to pay applicable fees (for paid services)
14.3 Suspension or Discontinuation of the Services
We may modify, suspend, or discontinue any part of the Services, including an entire application or a paid feature, at any time. If we permanently discontinue a Service you actively use, we will provide at least thirty (30) days' advance notice through the app, by email to registered users, or both, except where immediate suspension is required for legal, security, or safety reasons. If you have an active paid subscription when a Service is permanently discontinued, we will stop renewals in advance where feasible so you are not billed for a period after shutdown; refunds for already-billed periods are handled by Apple App Store or Google Play under their policies (see Section 12). Where reasonably practicable, we will give you an opportunity to export your data before a Service is discontinued.
14.4 Effect of Termination
Upon termination:
- Your access to our Services will cease
- Your User Content may be deleted (subject to our Privacy Policy and applicable laws)
- Some information may be retained in anonymized form for research and legal purposes
- All rights and licenses granted to you will terminate
15. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by:
- Posting updated Terms in our Services
- Sending email notification to registered users
- Displaying a prominent notice about changes
- Updating the "Last Updated" date at the top of these Terms
Your continued use of our Services after changes take effect constitutes acceptance of the updated Terms. If you do not agree to changes, you must stop using our Services.
16. Governing Law and Jurisdiction
These Terms are governed by the laws of South Carolina and the United States, without regard to conflict of law principles. Subject to Section 17, any disputes will be resolved exclusively in the state or federal courts located in Charleston County, South Carolina, and the parties consent to personal jurisdiction and venue in those courts.
16.1 App Store and Google Play End-User License Terms
App Store (iOS). If you obtained our app through the Apple App Store, you acknowledge that these Terms are between you and Technical Angler, LLC, not between you and Apple. Apple is not responsible for the app or for any claims related to it (including product liability, legal compliance, or intellectual property infringement). Apple is a third-party beneficiary of these Terms and may enforce them against you. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); Apple has no other warranty obligation. Maintenance, support, and the addressing of claims related to the app are Technical Angler's responsibility, not Apple's.
Google Play (Android). If you obtained our app through Google Play, your use is also subject to the Google Play Terms of Service. Google is not a party to these Terms.
16.2 California Users
Under California Civil Code Section 1789.3, California users of the Services are entitled to the following notice:
The provider of the Services is Technical Angler, LLC, a South Carolina limited liability company. You may contact us with questions or complaints at legal@technicalangler.com. Subscription fees, where applicable, are disclosed in the app at the point of purchase, as described in Section 12. The Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
17. Dispute Resolution
17.1 Informal Resolution and Notice of Dispute
Before filing any legal claim or initiating arbitration, you agree to attempt to resolve the dispute informally. You must first send a written notice of dispute to legal@technicalangler.com describing the nature and basis of the claim and the specific relief sought. Technical Angler will have sixty (60) days from receipt of the notice to attempt to resolve the dispute in good faith. Compliance with this informal resolution process is a condition precedent to initiating arbitration or any other legal proceeding.
17.2 Binding Arbitration
For disputes that cannot be resolved through the informal process described in Section 17.1, you and Technical Angler agree to resolve all claims through binding individual arbitration rather than in court, except for:
- Claims that qualify for small claims court in your county of residence or in Charleston County, South Carolina
- Intellectual property disputes
- Requests for injunctive or equitable relief
Arbitration will be conducted by a neutral arbitrator under the Consumer Arbitration Rules of the American Arbitration Association ("AAA"). Hearings will take place in Charleston, South Carolina, or in your county of residence, as determined under those rules.
17.3 Class Action Waiver
You and Technical Angler agree to bring claims only in an individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.
17.4 Jury Trial Waiver
To the extent any claim proceeds in court rather than arbitration, you and Technical Angler each waive any right to a trial by jury.
17.5 Right to Opt Out of Arbitration
You may opt out of the arbitration agreement in Section 17.2 and the class action waiver in Section 17.3 by sending written notice to Technical Angler, LLC at legal@technicalangler.com within thirty (30) days of first accepting these Terms. Your notice must include your name, the email address associated with your account, and a clear statement that you wish to opt out of arbitration. Opting out will not affect any other terms of this agreement.
18. General Provisions
18.1 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
18.2 Entire Agreement
These Terms, together with our Privacy Policy and any additional terms for specific Services, constitute the entire agreement between you and Technical Angler, LLC.
18.3 Assignment
You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations to any party at any time.
18.4 Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.
18.5 Force Majeure
We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control.

20. Special Provisions
20.1 Mobile Services
When using our Services on mobile devices:
- Standard messaging and data rates may apply
- You are responsible for mobile service charges
- We may send push notifications (which you can disable in device settings)
20.2 Updates and Modifications
We may update our Services from time to time to:
- Add new features or functionality
- Fix bugs or security issues
- Improve performance and user experience
- Comply with legal requirements
You are responsible for maintaining compatible devices and software.
20.3 Geographic Restrictions
Our Services may not be available in all geographic locations. We reserve the right to limit access based on geographic location, local laws, or other factors.
By using Technical Angler's Services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. This Terms of Service agreement is effective as of the date listed above and governs your use of Services provided by Technical Angler, LLC.
